Legal Action Over Garden Centre's Community Status
A legal battle is brewing in west London as a community garden centre faces an uncertain future. The Rural Activities Garden Centre (FRAGC), near Hayes, has been a beloved local attraction, maintained by adults with learning disabilities. The controversy began when Friends of the Rural Activities Garden Centre (FRAGC) submitted an application to list the site as an Asset of Community Value (ACV). This designation aims to protect land or buildings of cultural significance, allowing local groups time to prepare a bid if the site is put up for sale. But Hillingdon Council has been slow to respond, sparking a legal challenge.
The council initially promised to decide on the ACV application by January, but this deadline has passed. FRAGC's supporters argue that the council's inaction is a violation of statutory deadlines, and they are now seeking a judicial review. Hillingdon Council, led by the Conservative party, has been accused of ignoring the ACV application. Councillor Sital Punja, the deputy leader of the Labour group, expressed her disappointment, stating that the council's inaction is a betrayal of the community's trust. She further criticized the council's financial mismanagement, suggesting that their inability to meet deadlines will result in a costly legal battle.
To fund the legal proceedings, FRAGC has launched a fundraiser, aiming to raise £9,750. This money will be used to request a mandatory order, compelling the council to make a decision on the ACV nominations. The campaigners believe that this legal action is necessary to protect the garden centre's legacy and ensure its future as a valuable community asset.
